BY ACCESSING OR USING https://aralabs.ai OR ANY OF ITS SUBDOMAINS, YOU AGREE TO BE BOUND BY THESE TERMS OF USE. If you do not agree, do not use this Website. These Terms cover the website - use of the ARA Software is separately governed by the Community Edition EULA or the ARA Software Licensing Agreement.

Section 1 - About These Terms

1.1 Who We Are

ARA AI Labs Private Limited ("ARA", "we", "us", "our") is a company incorporated in India under the Companies Act, 2013. We develop and distribute the ARA decision data plane - a binary software product for machine learning infrastructure teams. Legal contact: legal@aralabs.ai.

1.2 What These Terms Cover

These Website Terms of Use ("Terms") govern your access to and use of the ARA website at https://aralabs.ai and all its subdomains, including the documentation portal, blog, download pages, and API endpoints that serve the website (collectively, the "Website"). These Terms do not govern your use of the ARA Software itself - that is covered by:

  • The ARA Community Edition EULA, for users of the free Community Edition.
  • The ARA Software Licensing Agreement, for users of Starter, Growth, or Enterprise paid tiers.

1.3 Acceptance

By visiting, browsing, submitting a form, requesting a download, or otherwise using the Website, you confirm that you have read and accepted these Terms and our Privacy Policy. If you are acting on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.

1.4 Age

The Website is intended for use by professionals aged eighteen (18) or older. By using the Website, you confirm that you are at least 18 years old.

1.5 Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date. For material changes, we will make reasonable efforts to notify registered users by email. Your continued use of the Website after the updated Terms take effect constitutes acceptance. If you do not accept the changes, stop using the Website.

Section 2 - Website Content and Permitted Use

2.1 Permitted Use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable permission to:

  • Access and browse the Website for your own informational and professional purposes.
  • Download publicly available resources (documentation, release notes, blog posts) for personal reference.
  • Submit forms to request information, demos, downloads, or design partner participation.
  • Access the ARA Software download through the email-gated download flow, subject to the Community Edition EULA.

2.2 Prohibited Conduct

You must not:

  • Use any automated tool (scraper, bot, crawler, spider) to extract content from the Website without prior written consent.
  • Attempt to bypass, circumvent, or defeat any access control, rate limit, email verification, machine activation challenge, or token-based download gate.
  • Submit false, misleading, or fraudulent information in any form, including the download registration, contact form, or design partner application.
  • Use the Website in any way that violates applicable law, including laws governing unsolicited communications, data protection, export controls, or computer fraud.
  • Introduce viruses, malware, or any harmful code to the Website or its backend infrastructure.
  • Probe, scan, or test the vulnerability of the Website or its backend systems without written authorisation from ARA.
  • Use the Website to impersonate ARA, its employees, or any other person.
  • Republish, redistribute, or commercially exploit the Website's content (including documentation and blog posts) without written permission.
  • Use the Website to harvest email addresses or other personal data for any third party's purposes.
  • Access or attempt to access the administrative interface (/admin) without explicit authorisation from ARA.

2.3 Download Registration

To download the ARA Community Edition binary, you must provide a valid email address and accept the Community Edition EULA. By submitting the download request form, you confirm that the email address is your own, accept that we will send a single-use activation link, accept that we may send product-related communications (with unsubscribe available at any time), and acknowledge that your registration data will be processed as described in our Privacy Policy.

2.4 Contact and Demo Requests

When you submit the contact or demo request form, we use your data solely to respond to your enquiry and assess your interest in ARA's products. We do not add you to marketing lists without explicit consent, and we will not share your contact data with third parties for their own marketing purposes.

2.5 Design Partner Applications

When you apply to the ARA Design Partner Programme, your information is used to evaluate your suitability for the programme. Accepted design partners will enter into a separate design partner agreement governing the terms of participation.

2.6 Docs Access

Technical documentation may be available behind an email-challenge gate. Docs access tokens are personal and must not be shared. We reserve the right to revoke docs access if we detect misuse, including token sharing or automated bulk download of documentation.

Section 3 - Machine Activation

3.1 Activation Requirement

The ARA Community Edition binary requires a one-time machine activation. Activation cryptographically binds the binary to a specific machine identifier. By initiating machine activation, you agree to:

  • Submit your machine identifier (a hardware- or OS-derived fingerprint) and your registered email to the ARA activation API.
  • Store the resulting signed License Key securely and not share it with any other person or deploy it on machines other than the one for which it was issued.
  • Re-activate if you change hardware or reinstall the OS in a way that alters the machine identifier, subject to the re-activation limits in the Community Edition EULA.

3.2 Activation Data

The machine identifier submitted during activation is a non-reversible hash of hardware attributes. It does not contain personally identifiable information on its own but is treated as personal data because it is linked to your email. Full details are in our Privacy Policy.

3.3 Activation Limits

Community Edition permits activation on a maximum number of machines as specified in the Community Edition EULA. ARA reserves the right to investigate and revoke activations that appear to violate activation limits.

Section 4 - Intellectual Property

4.1 ARA's Intellectual Property

All content on the Website - including text, graphics, logos, product names, documentation, blog posts, diagrams, and code examples - is owned by or licensed to ARA AI Labs Private Limited and is protected by Indian and international intellectual property laws, including the Copyright Act, 1957 (India) and applicable trademark law.

4.2 Limited Licence to Website Content

We grant you a personal, non-commercial, non-exclusive, non-transferable licence to view, read, and print Website content (excluding the Software) solely for your own informational and evaluation purposes. You may share links to Website pages. You may not reproduce, republish, distribute, create derivative works from, or commercially exploit any Website content without our prior written consent.

4.3 Trademarks

"ARA", the ARA logotype, "ARA Decision Data Plane", "aralabs.ai", and related marks are trademarks or service marks of ARA AI Labs Private Limited. Nothing on the Website grants any right to use our marks without prior written permission.

4.4 Feedback

If you submit feedback, suggestions, or ideas about the Website or the Software through any channel, you grant ARA a perpetual, irrevocable, royalty-free, worldwide licence to use, implement, and incorporate that feedback without obligation or compensation to you.

4.5 Patents

The ARA Software and underlying technology are protected by patents IN 202521127705 (India) and USPTO 19/556,145 (United States). Nothing on this Website grants any licence to these patents.

Section 5 - Third-Party Links and Services

5.1 External Links

The Website may contain links to third-party websites, including GitHub, Discord, or other external resources. These links are provided for convenience only. ARA does not control, endorse, or accept responsibility for the content, privacy practices, or terms of any third-party website. Clicking external links is at your own risk.

5.2 Community Channels

ARA may operate or participate in community channels (Discord, GitHub Discussions, or similar). Use of those channels is subject to the terms of service of the platform on which they are hosted, as well as any additional community guidelines ARA publishes.

5.3 CDN and Infrastructure

The Website uses third-party content delivery, hosting, and infrastructure services. These providers process technical data (IP addresses, request metadata) to deliver the Website to you. Details are in our Privacy Policy.

Section 6 - Disclaimers

6.1 Website "As Is"

THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ARA DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

6.2 Availability

We do not warrant that the Website will be available without interruption, error-free, or free from viruses or other harmful components. We may suspend, withdraw, or restrict access to the Website or any feature at any time, with or without notice, for operational, maintenance, or legal reasons.

6.3 Accuracy of Content

We make reasonable efforts to keep Website content accurate and current. However, content - including documentation, roadmaps, pricing, and blog posts - may be out of date or contain errors. Content on the Website does not constitute legal, financial, or technical advice. Verify information independently before relying on it for business decisions.

6.4 Blog and Publications

Blog posts, technical articles, and opinion pieces reflect the views of their authors at the time of writing. They do not constitute official ARA product documentation, commitments to roadmap items, or representations of current product capabilities. Benchmark results in blog posts are provided for illustrative purposes and may not reflect your specific environment.

6.5 No Warranty on Downloads

The ARA Software is licensed under separate agreements (EULA or Software Licensing Agreement), not these Terms. Any warranty applicable to the Software is set out in the applicable software agreement.

Section 7 - Limitation of Liability

7.1 Exclusion of Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARA SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, INCLUDING LOSS OF DATA, PROFITS, BUSINESS, OR GOODWILL, EVEN IF ARA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.2 Aggregate Cap

ARA's total aggregate liability to you for all claims arising from or related to the Website (not the Software) shall not exceed INR 10,000 (ten thousand Indian Rupees). This cap applies regardless of the basis of the claim (contract, tort, statute, or otherwise).

7.3 Essential Basis

You acknowledge that these limitations of liability are an essential element of the basis of the agreement between you and ARA and that ARA would not operate the Website without them.

7.4 Exceptions

Nothing in these Terms limits or excludes ARA's liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Indian law.

Section 8 - Data Protection and Privacy

8.1 Privacy Policy

Our collection, use, storage, and disclosure of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully before using the Website.

8.2 DPDP Act Compliance

ARA processes personal data of individuals located in India in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act). Where we collect personal data through the Website, we do so on the basis of consent, which you provide at the point of data collection. You may exercise your rights under the DPDP Act (access, correction, erasure, grievance redressal) by contacting legal@aralabs.ai.

8.3 GDPR - International Visitors

If you are located in the EEA, UK, or Switzerland, ARA processes your personal data in compliance with the GDPR or UK GDPR. Our Privacy Policy sets out the lawful bases for processing and your rights under those frameworks.

8.4 Cookies

The Website uses only technically necessary cookies. We do not use advertising cookies, third-party tracking cookies, or analytics cookies that transmit data to external parties. If we add optional cookies in the future, we will update our Privacy Policy and obtain consent before placing them.

8.5 Email Communications

By registering for a download, you consent to receiving transactional emails from ARA (activation links, download confirmations, security advisories, version release notifications). You may unsubscribe from non-essential emails at any time by clicking the unsubscribe link or writing to legal@aralabs.ai. Transactional emails necessary for product operation cannot be opted out of while you have an active registration.

Section 9 - Security

9.1 Our Security Measures

We implement commercially reasonable technical and organisational security measures including TLS encryption for data in transit, rate limiting on all API endpoints, per-IP request throttling, single-use cryptographic tokens for download and activation flows, and server-side validation of all inputs.

9.2 Your Responsibilities

You are responsible for maintaining the confidentiality of any tokens, activation links, or License Keys you receive through the Website. You must not share these with any third party. If you suspect your activation token or License Key has been compromised, notify us immediately at security@aralabs.ai.

9.3 Responsible Disclosure

We welcome responsible disclosure of security vulnerabilities. If you discover a security issue in the Website or the ARA Software, please report it to security@aralabs.ai with a description of the vulnerability, steps to reproduce, and your contact details. We will acknowledge receipt within five (5) business days and work in good faith to remediate verified vulnerabilities. We ask that you do not publicly disclose the vulnerability until we have had a reasonable opportunity to fix it.

9.4 Prohibited Security Testing

You must not perform penetration testing, vulnerability scanning, fuzzing, or any other security testing against the Website or its backend infrastructure without prior written authorisation from ARA. Unauthorised testing is a violation of these Terms and may constitute a criminal offence under the Information Technology Act, 2000 (India).

Section 10 - Termination and Suspension

10.1 Termination by You

You may stop using the Website at any time. If you wish to have your registration data deleted, submit a request to legal@aralabs.ai. We will process deletion requests in accordance with the DPDP Act and our Privacy Policy.

10.2 Suspension or Termination by ARA

We reserve the right to suspend or terminate your access to the Website, revoke any activation token or License Key issued through the Website, and take other appropriate action if we believe you have violated these Terms, provided false information, or your use poses a security risk, or we are required to do so by law or court order.

10.3 Effect of Termination

On termination, your permission to use the Website ends immediately. Sections 4, 6, 7, 8, 9, 11, and 12 survive termination.

Section 11 - Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods is excluded.

11.2 Dispute Resolution

  • Informal resolution: You must first contact us at legal@aralabs.ai and give us thirty (30) days to attempt to resolve the dispute informally.
  • Arbitration: If the dispute is not resolved informally, it shall be submitted to final and binding arbitration in Pune, Maharashtra, India, under the Arbitration and Conciliation Act, 1996 (India), by a sole arbitrator mutually agreed upon by the parties.
  • Emergency relief: Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction without waiving the right to arbitration.

11.3 Indian Consumer Law

If you are an individual consumer using the Website for personal purposes (not business purposes), you may also have rights under the Consumer Protection Act, 2019 (India). Nothing in these Terms limits your statutory consumer rights under Indian law.

11.4 International Visitors

The Website is operated from India. If you access the Website from outside India, you are responsible for compliance with your local laws. We make no representation that the Website or its content is appropriate or available in all jurisdictions.

Section 12 - General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ARA regarding your use of the Website. Your use of the ARA Software is separately governed by the applicable software agreement.

12.2 Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if it cannot be made valid, it shall be severed. The remaining provisions continue in full force and effect.

12.3 Waiver

Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right. Any waiver must be in writing and signed by an authorised representative of ARA.

12.4 No Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. ARA may assign these Terms freely.

12.5 No Third-Party Beneficiaries

These Terms are for the benefit of you and ARA only and do not confer any rights on third parties.

12.6 Force Majeure

ARA shall not be liable for any delay or failure in Website availability caused by events beyond our reasonable control, including acts of God, power failures, internet outages, government orders, or pandemic-related restrictions.

12.7 Notices

Notices to ARA under these Terms must be sent in writing to legal@aralabs.ai. Notices are effective upon confirmed receipt by ARA.

12.8 Language

These Terms are written in English. In the event of any conflict between the English version and any translation, the English version prevails.
